Acceptance of Terms

By accessing and using the nourishloft platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Use License

Permission is granted to temporarily access the materials on nourishloft for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials
use the materials for any commercial purpose, or for any public display
attempt to decompile or reverse engineer any software contained on the platform
remove any copyright or other proprietary notations from the materials
transfer the materials to another person or mirror the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by nourishloft at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Account Registration

To access certain features of the platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

User Content

Our platform may allow you to submit, upload, publish or otherwise make available content including but not limited to text, photographs, videos, and other materials. You retain all rights in, and are solely responsible for, the content you make available through the platform.

By making any content available through the platform, you grant to nourishloft a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your content in connection with operating and providing the platform.

Prohibited Uses

You may use the platform only for lawful purposes and in accordance with these Terms. You agree not to use the platform:

in any way that violates any applicable national or international law or regulation
to transmit, or procure the sending of, any advertising or promotional material without our prior written consent
to impersonate or attempt to impersonate nourishloft, a nourishloft employee, another user, or any other person or entity
to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the platform, or which may harm nourishloft or users of the platform
to introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
to attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the platform

Intellectual Property

The platform and its original content, features, and functionality are and will remain the exclusive property of nourishloft and its licensors. The platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of nourishloft.

Educational Content

All educational materials, including but not limited to lectures, videos, course materials, and assessments provided through the platform, are for educational purposes only. The information provided does not constitute professional advice and should not be relied upon as such.

nourishloft reserves the right to modify, suspend, or discontinue any course or educational content at any time without prior notice.

Payment and Subscriptions

Certain features of the platform may require payment of fees. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the platform.

All fees are non-refundable unless otherwise stated in our refund policy. We reserve the right to change our fees at any time, with notice provided in advance of such changes taking effect.

Termination

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the platform or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. nourishloft makes no representations or warranties of any kind, express or implied, as to the operation of the platform or the information, content, or materials included therein.

You expressly agree that your use of the platform is at your sole risk. To the full extent permissible by applicable law, nourishloft disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall nourishloft, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform.

Indemnification

You agree to defend, indemnify, and hold harmless nourishloft and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the platform, or your violation of these Terms.

Third-Party Links

The platform may contain links to third-party websites or services that are not owned or controlled by nourishloft. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that nourishloft shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the platform.

Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our platform, and supersede and replace any prior agreements we might have had between us regarding the platform.
